PROPOSED AMENDMENTS TO THE

CHARTER OF THE CITY OF CHARDON ON THE NOVEMBER 6, 2018 BALLOT

On the November 6 ballot, Chardon City voters will be asked to consider four separate amendments to the City’s Charter. A majority affirmative vote is necessary for passage of each proposed charter amendment. Following review by an eleven member Charter Review Committee, City Council elected to place the following 3 charter amendments (Issues 9-11) before the voters:

Issue 9. A PROPOSED CHARTER AMENDMENT TO §3.06(g) OF THE CHARTER, POWERS OF THE COUNCIL.

Section 3.06(g) of the Charter, POWERS, shall be amended in its entirety to read as follows:

§3.06 POWERS

(g) The power to adopt and provide for the enforcement of zoning classifications, districts, uses and regulations by ordinance; to adopt and provide for the enforcement of ordinances regulating the subdivision and platting of land within the Municipality; to adopt and provide for the enforcement of ordinances requiring actual construction or assurance of construction of streets, utility lines and facilities, sidewalks, curbs and gutters and other improvements or facilities as a condition precedent to the approval of a plat of a subdivision; to adopt and provide for the enforcement of ordinances regulating the construction, reconstruction, alteration, enlargement, repair or demolition of buildings and other structures within the Municipality; to adopt and to provide for the enforcement of housing codes or ordinances, regulating the use and occupancy of any land, building or structure within the Municipality.

Issue 10. A PROPOSED CHARTER AMENDMENT TO §6.08 OF THE CHARTER, FIRE DEPARTMENT.

Section 6.08 of the Charter, FIRE DEPARTMENT, shall be amended to identify the provider of fire protection and emergency services by its registered legal name, the Chardon Fire Department, Inc.

Issue 11. A PROPOSED CHARTER AMENDMENT TO §9.01 OF THE CHARTER, NOMINATIONS AND ELECTIONS.

§9.01 NOMINATIONS AND ELECTIONS.

Nominations for elective offices of the Municipality shall be made only by petition signed by registered electors of the Municipality, in number of at least two percent (2%) of the number voting in the Municipality at the last preceding general election but not less than 25 signatures, and shall be accompanied by the written acceptance of the nominee. The nomination of each candidate shall be made by a separate petition, signed by each candidate who shall be a qualified elector of the Municipality, but such petition may be circulated in separate parts, which shall be filed, however, as one instrument. No primary election shall be held for the selection of any candidate for any elective office of the Municipality; and no nomination for any such office shall be of any effect unless made as required by this Article. The ballot used in the election of officers of the Municipality shall be placed upon the same ballot and shall be rotated in the manner provided by the laws of Ohio. Except as otherwise provided in this Charter, the laws of Ohio shall govern the nomination and election of the elective officers of the Municipality. Any matter which, by the terms of this Charter, may be submitted to the electors at a special election, may be submitted at the time of a primary or general election.

The Charter amendment proposed by Issue 14 was proposed by an initiative petition that was circulated which placed the amendment on the upcoming ballot.

Issue 14. A PROPOSED AMENDMENT TO SECTIONS, 2.01, 3.01, 3.03, 3.04, 3.11 AND 3.12 OF THE CHARTER OF THE CITY OF CHARDON TO PROVIDE FOR A MAYOR TO BE ELECTED AT THE GENERAL ELECTION IN NOVEMBER 2019 BY THE CITY’S ELECTORATE AND SERVE AS A SEVENTH COUNCIL MEMBER; TO PROVIDE FOR THE AUTHORITY, DUTIES AND COMPENSATION OF THE MAYOR, TO PROVIDE FOR SIX OTHER ELECTED REGULAR COUNCIL MEMBERS, TO PROVIDE FOR A VICE-MAYOR TO BE APPOINTED BY THE MAYOR FROM THE REMAINING COUNCIL MEMBERS AND TO ACT AS MAYOR IN THE MAYOR’S ABSENCE OR INABILITY TO SERVE.

Section 2.01 Form of Government

The Council shall elect a President of Council, who shall also have the title of Mayor and a Vice-President of Council who shall also have the title of Vice-Mayor or as herein provided and will consist of six (6) elected council members and one (1) elected mayor, who will also serve as a seventh council member. The Council shall appoint a manager who shall execute the laws and administer the government of the Municipality.

Section 3.01 Composition and Terms

Three (3) members of Council shall be elected at the general election in the year 1979 for a term of four (4) years and three (3) members of Council shall likewise be elected every fourth year thereafter.

Four (4) Three (3) members of Council shall be elected at the general election in the year 1981 2021 for a term of four (4) years and four (4) three (3) members of Council shall be so elected every fourth year thereafter.

One (1) Mayor/member of Council shall be elected at the general election in the year 2019 for a term of two (2) years. Beginning in the general election in November 2021, the Mayor shall be elected by a vote of the general public for a term of four (4) years and the Mayor shall be so elected every fourth year thereafter.

Section 3.03 President of Council The Mayor

At its organizational meeting following each municipal election, Council shall choose by affirmative vote of at least four (4) members, one of its members as President of Council, who shall also have the title of Mayor, to serve for two (2) years or until his/her successor shall be elected and shall qualify for the office and in the event the Council shall fail to elect a President of Council, the Council member receiving the highest number of votes at the most recent municipal election shall become President of Council. The President of Council shall retain his/her right to vote, but shall have no veto power. He/she shall, in addition to his/her powers, rights and duties as a member of Council The Mayor elected in the general election in November 2019 and thereafter shall retain his/her vote as a member of Council, but shall have no veto. In addition to his or her powers, rights, and duties as a member of council, the Mayor shall preside at all meetings of Council and shall be recognized as the official head of the Municipality for all ceremonial purposes, by the Governor for military or defense purposes, and by the courts for the purpose of serving of civil process. The President of Council shall also have jurisdiction and authority to act as presiding judicial officer in civil proceedings to the extent the President of Council is empowered to do so by the laws or the Constitution of the State of Ohio and by the ordinances of the Municipality. The Mayor shall perform all other duties prescribed for him/her in this charter, or by general law.

Section 3.04 The Vice-President of Council Mayor

Council shall at the same meeting and in the same manner and for a like term of two (2) years choose another of its members Vice-President of Council, who shall also have the title of Vice-Mayor. The Mayor shall designate a council member to be the Vice-Mayor in the event that the Mayor is absent or unable to fulfill his or her mayoral duties. The appointment will last for two years. The Vice-President of Council Vice-Mayor shall retain his/her right to vote, even while acting as the President of Council Mayor as herein provided, and shall exercise all of the powers and perform all of the duties of the President Mayor in case of temporary absence or disability of the President Mayor and shall succeed to the office of President Mayor in case of any vacancy therein, and in such event, Council shall in the same manner elect a new Vice-President to serve until his/her successor shall be elected and assume office by simple majority vote a new Vice-Mayor to serve until the next Mayor is elected.

Section 3.11 Salaries and Compensation

Council shall fix the salaries or compensation of the President of Council, Mayor, Vice President of Council, Manager, members of Council and each officer, employee or member of any board or commission of the Municipality either elected or appointed.

The salary of each Council member shall be one thousand two hundred dollars ($1,200) per year unless changed by ordinance. A Council member, while acting as President of Council the Mayor, shall receive additional compensation in an amount to be fixed by Council prior to his/her assumption of the office as herein provided.

The compensation of each member of Council and said additional compensation of a Council member acting as President of Council Mayor shall be fixed by Council not less than 120 days immediately preceding the date of the next municipal election. No change of such compensation can become effective for any Council member during the current term of any Council member enacting such ordinance.

The compensation of every other officer, employee and member of any board or commission of the Municipality as fixed by Council, shall be subject at all times to the power of Council to provide otherwise by ordinance or resolution by general classification or otherwise, and may be changed at any time at the discretion of Council. Council may authorize the payment or reimbursement of expenses incurred by any officer or employee or member of any board or commission of the Municipality for traveling or other expenses incidental to the authorized furtherance of the Interests of the Municipality.

Section 3.12 Vacancies

The temporary appointee shall be chosen by a majority vote of the remaining members of Council, except that if a choice by vote of Council not be made within thirty (30) days of the vacancy occurring, the President of Council Mayor shall choose the temporary appointee.

Whenever the office of a Council member shall become vacant during his/her term, the vacancy shall be filled by temporary appointment as provided in this section until a successor is elected in accordance with Article IX of the Charter. The successor/ member-elect shall take office on the first day In January next following the election and serve the unexpired portion of the term. If the term expires on December 31 of the year of election, then the election shall be for a full term.

A resolution opposing State Issue 1 to reduce penalties for crimes of obtaining, possessing and using illegal drugs, for the reason that the amendment if adopted would greatly alter sentencing laws for illegal street drugs, shift costs of drug treatment from the State to local governments resulting in an increased tax burden upon local taxpayers and, if passed, another constitutional amendment must be proposed and passed to amend Issue 1.
