 In accordance with sections 153.05 and 153.54 of the Ohio Revised Code, for all bids in excess of FIFTY THOUSAND ($50,000.00) DOLLARS, each bidder shall provide with their bid, a certified check representing TEN (10%) PERCENT of the proposal, drawn on a solvent bank, and payable to the Russell Township or a bid bond in the sum of ONE HUNDRED (100%) PERCENT of the proposal in lieu thereof , and must accompany each and every proposal as a guarantee that if the bid is accepted, a contract will be entered into with the Russell Township Board of Trustees, in the manner provided by law.

 A performance bond in the amount of 100% of the contract price will be required at the time the bidder enters into the contract.

 This work shall utilize Prevailing Wage Requirements.

 Domestic Steel Use Requirements as specified in Section 153.001 of the Revised Code apply to this project. Copies of Section 153.001 of the Revised Code can be obtained from any of the offices of the Department of Administrative Services. All steel products must meet the requirements of the ODOT CMS 106.09.

 Bids of Corporations not chartered in Ohio MUST be accompanied by proper certifications that such Corporation is authorized to do business in Ohio.

 Attention of the Bidder is directed to the requirements that each proposal must be accompanied by a non-collusion affidavit, properly executed by the Bidder.  Further, the successful Bidder will be required to execute a bidder’s affidavit of personal property tax delinquency required by Sec. 5719.042 of the Ohio Revised Code.  No payment shall be made on any Contract for which no such affidavit has been submitted.

 The Contractor and all sub-contractors for this project must be enrolled in the Ohio Bureau of Workers’ Compensation Drug-Free Workplace Program or in a similar program approved by the Bureau of Workers’ Compensation. Any Contractor that does not meet his requirement will have their bid deemed non-responsive and cannot be awarded the contract.

 The Russell Township Board of Trustees reserves the right to cancel any solicitation, and to accept or reject any or all bids and to waive informalities.  In addition, the Russell Township Board of Trustees reserves the right to participate in state contracts which the Department of Administrative Services, Office of State Purchasing has entered in to for the purchase of supplies, services, equipment, and certain materials pursuant to Ohio Revised Code Section 125.04.  No bids may be withdrawn for at least ninety (90) days after the opening thereof.

 Each bidder must ensure that all employees and applicants for employment are not discriminated against because of race, color, sex or national origin per section 153.59 of the ORC.
