Unknown Heirs at Law, Devisees, Legatees, Administrators, and Executors of the Estate of Michael Carothers, whose present place of residence is unknown, will take notice that on February 17, 2023, Federal Home Loan Mortgage Corporation, as Trustee for the benefit of the Freddie Mac Seasoned Loans Structured Transaction Trust, Series 2021-1, filed its Complaint  in Foreclosure in Case No. 23-F-000103 in the Court of Common Pleas Geauga County, Ohio, 100 Short Court, Chardon, OH 44024, alleging that the Defendants, Unknown Heirs at Law, Devisees, Legatees, Administrators, and Executors of the Estate of Michael Carothers, have or claim to have an interest in the real estate located at 11658 Pekin Road, Newbury, OH 44065, PPN #23-297500 and 23-297600.  A complete legal description may be obtained with the Geauga County Auditor’s Office located at 231 Main St., Chardon, OH 44024-1293.

The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a  concurrent mortgage deed given to secure the payment of said note and conveying  the premises described, have been broken, and the same has become absolute.

The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner’s claim in the property order of its priority, and for such other and further relief as is just and equitable.

Browning, the current lessor and owner of certain real property located at 13264 Bass Lake Road, Chardon, Geauga County, Ohio, Parcel No. 21-032500, containing 18.21 acres as more particularly described in the Warranty Deed recorded on August 4, 1992, in the Geauga County Records at Vol. 911, Page 609, declares the following Oil and Gas Lease, forfeited and void:

Oil and gas lease between Robert J. Boddy, as lessor, and Teri Leasing Company, as lessee, dated September 30, 1986 and recorded October 6, 1986 at Book 769, Page 798 in the Geauga County, Ohio records.

There are no producing or drilling oil and gas wells on the Property.  The above-described lease is forfeited and void because the lease has expired by its own terms and, further, delay rental payments have not been made by lessee or its successors and assigns to the owner of the Property.

Nina M. Browning as the owner and current lessor, intends to file an Affidavit of Forfeiture of the above described Oil & Gas Lease in the Geauga County Records at least thirty (30) but not more than sixty (60) days of the date of this notice, in accordance with R.C. §5301.332.  After such time, the encumbrance of the Oil and Gas Lease on the Property shall be of no further force and effect nor shall the rights of the owner of the Property be affected by or subject to the rights of any property to the Oil and Gas Lease.

Atlas Energy Group, Inc. merged with the surviving corporate entity, Atlas America, Inc., which assigned the Oil and Gas Lease to The East Ohio Gas Company on or about February 4, 1982, and recorded in the Geauga County, Ohio Records at Volume 20, Page 284 on May 10, 1982.

NOTICE OF CONSENT JUDGMENT AND SETTLEMENT AGREEMENT

23-M-000613 – Nina M. Browning and The Paul Carnabuci, Jr. Trust v. Munson Township Board of Trustees

Please be advised that the Township of Munson located in Geauga County, by and through the Munson Township Board of Trustees, intends to enter into a consent judgment entry and agreement in the case captioned Nina M. Browning and The Paul Carnabuci, Jr. Trust v. Munson Township Board of Trustees, Geauga County Court of Common Pleas case number 23-M-000613.  This consent judgment entry serves to remove an unenforceable variance condition issued in 1992 by the Munson Township Board of Zoning Appeals regarding permanent parcel number 21-032500, commonly known as 13264 Bass Lake Road, Munson Township, Ohio. A copy of the proposed consent entry is available for review at the township offices during normal business hours.

NOTICE OF PUBLIC HEARING

APPEAL FOR VARIANCE

Notice is hereby given that the Burton Township Board of Zoning Appeals will conduct a public hearing on an application for an appeal for a variance to the Burton Township Zoning Resolution on the 20th day of December, 2023 at 6:00 o’clock p.m. at: Burton Township Administration Building, 14821 Rapids Road, Burton, Ohio 44021.

This application #1626-23, submitted by Alexander C. Ciarlillo requests an area variance to allow the existing parcel to be split into one conforming lot of 5.43 acres and one nonconforming lot of 2.48 acres.  The ultimate goal is to have a new (conforming) lot to build a new home in the future. He seeks relief from Article IV, Section 402.5, Minimum Lot Area, of the Burton Township Zoning Resolution as amended August 14, 2019. He asks that this be granted for the lot located at: 15701 Claridon Troy Road in Burton Township Ohio, Parcel #04-137300.
