19-M-000359 – Brian A. Brockway, Plaintiff, vs. Douglas E. Price, et al., Defendants.

James R. Price (“Price”) and the Unknown Heirs, Devisees, Grantees, Assigns and Executor/Administrator of Daniel Price, deceased (“Price Heirs”) whose addresses are unknown and cannot, by reasonable diligence, be ascertained, will take notice that on the 23rd day of April, 2019, the undersigned, Plaintiffs Brian A. and Carol A. Brockway (collectively, “Plaintiffs”) filed their complaint against Defendants Douglas E. Price, as executor of the Estate of Gertrude D. Price, Douglas E. Price, Bonna DeMarco, John L. Price, Price, the Price Heirs, Scott Warner, and Theresa Warner in the Court of Common Pleas of Geauga County located at 100 Short Court Street, #300, Chardon, Ohio 44024, the same being Case No. 19-M-000359 in said Court. Plaintiffs allege that Defendants, may have claim to a certain parcel of land (“Price Parcel”) located in Geauga County, which Plaintiffs have been using by planting numerous trees and farming and cultivating the land since in or about 1986 and, in which Plaintiffs are seeking to quiet title. The Price Parcel is located on Claridon Troy Road in Chardon, Ohio in Geauga County and is known as permanent parcel number 12-095264. Plaintiffs’ property and the Price Parcel share borders on the Northeast side of Plaintiffs’ property.

Plaintiffs allege that they have used the Price Parcel in excess of twenty-one (21) years, which use was open, notorious, continuous and adverse and thus, they have adversely possessed the Price Parcel and are entitled to title of the Price Parcel. Alternatively, Plaintiffs allege that the adjoining land owners of Plaintiffs’ property and the Price Parcel have treated Plaintiffs as owning the Price Parcel since in or about 1986, which is a period in excess of twenty-one (21) years and thus, they are entitled to title the Price Parcel under the doctrine of acquiescence.

Plaintiffs request the following relief as to all Defendants:

a. that title to the Price Parcel be vested in Plaintiffs;

b. that Plaintiffs be declared the true and lawful owners of the Price Parcel;

c. that title be quieted from and against any Defendants or others claiming through it and that all claims of any other party be set forth or be forever barred;

d. that title in the Price Parcel be quieted and title be vested in Plaintiffs, their heirs and assigns in fee simple absolute; and

e. for such further relief as is just, proper and equitable.

Defendants Price and the Price Heirs are required to answer on or before the 28th day following the last publication of this notice.

NOTICE OF PUBLIC HEARING

City of Chardon

Residents of the City of Chardon shall take note that a public hearing shall be conducted by the Council of the City of Chardon in Council Chambers of the Chardon Municipal Center, 111 Water Street, Chardon, Ohio at 6:20 P.M. upon the 12th day of September, 2019.

Said hearing is to provide the public an opportunity to comment regarding an assignment of zoning classification to a parcel that is being annexed into the City of Chardon (Parcel ID#15-703829, XXX Chardon Windsor Road). The proposed zoning classification is “S” Special District. The property is located on the south side of Chardon Windsor Road approximately 100 ft. east of the intersection of Grant Street and Chardon Windsor Road/South Hambden Street. The address of the property is XXX Chardon Windsor Rd., Chardon, OH 44024, with Parcel ID# 15-703829. The total acreage is 1.00 acres and is owned by the City of Chardon.

A copy of the Zoning Map Amendment is on file and available for public inspection in the office of the Clerk of Council of said City, weekdays between the hours of 8:00 a.m. and 5:00 p.m.
