Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.

Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.

NOTICE OF PUBLIC HEARING

Troy Township

Notice is hereby given that the Troy Township Board of Zoning Appeals will conduct a public hearing on an application for an appeal for a variance to the Troy Township Zoning Resolution on the 24th day of November, 2025 at 7:00 o’clock p.m. at the Troy Community Center, 13950 Main Market Road, Burton, OH 44021.

The following applications submitted by Geauga Highway Co., requests that they be granted relief regarding USE zoning certificates for his paving company. Applications for the below appeals pertain to Article IV. ZP25-37 Section 401.0(A) which states any use not listed in the resolution shall not be permitted unless and until a zoning amendment to provide for such use has been adopted and is in effect in accordance with Article XII or a variance has been granted in accordance with Article IX; paving companies are not a regulated use. ZP25-38 Section 401.0(I) which states no use shall be permitted or authorized to be established which, when conducted in compliance with the provisions of this Resolution, and any additional conditions and requirements prescribed, is or may become hazardous, noxious, or offensive due to emission of odor, smoke, fumes, cinder, dust,  noise, gas, vibration, electrical interference, refuse matter, water carried wastes, or which will interfere with adjacent landowners’ enjoyment of the use of their lands; a neighbor complains about noise and lights in early morning and after dark and there is water run-off. ZP25-39 Section 401.0(N) which states the storage, incineration, or burial of asphalt, pesticides, garbage, refuse, and hazardous waste or chemicals shall be prohibited; currently there is a pile of culvert pipes mixed with dirt. Applicant also requests that he be granted relief regarding AREA zoning certificates for the following regulations currently out of compliance: ZP25-40 Yard Setbacks Section 403.6(A) states minimum front yard setback is 75 feet and each side yard setback is 25 feet; current front yard setback is approximately 30 feet on Main Market Rd. & 17 feet on Nash Rd. and side yard setback is approximately 5 feet on the east side & 10 feet on the west side.  ZP25-41 Current Lot Coverage Section 403.8(A) states the maximum lot coverage shall be 30 percent; current lot coverage is 58.5 percent for a variance of 28.5 percent. ZP25-42 Proposed Lot Coverage Section 403.8(A) states the maximum lot coverage shall be 30 percent; applicant is proposing a lot coverage of 86 percent for a variance of 56 percent. ZP25-43 Adequate parking & loading/unloading spaces Section 600.0(A) states there must be adequate parking & such spaces are to be used only for parking or loading/unloading of vehicles; currently parking is in the grass/yard. ZP25-44 Materials for all parking, loading/unloading spaces, driveways, aisles, & other circulation areas Section 600.0(E) states with such material to provide a durable all weather & dust-free surface, including aggregate, concrete or asphalt; currently vehicles are being parked in the grass on the south side of the property. ZP25-45 Properly illuminated for all parking & loading/unloading spaces Section 600.0(G) states non-daylight hours shall be properly illuminated to avoid accidents and shall be arranged as to reflect the light away from adjoining property or roads & be within the regulations for the zoning district in which located; currently has no lights out. ZP25-46 Parking lots striped Section 600.0(H) states all parking lots shall be striped or otherwise delineated between spaces to facilitate the movement into or out of parking spaces; currently there is no designated parking area. ZP25-47 Number of parking spaces Section 601.0(E) states permitted 1 per 2 employees on largest shift & 1 per business vehicle; applicant states 10 spaces are required and shows a place on the site plan with no dimensions. ZP25-48 Width & length of parking spaces & total area Section 602.0 states minimum width of 10 feet, length of 20 feet & total area of 200 square feet; currently there are no parking spaces stripped. ZP25-49 Loading/unloading spaces Section 603.0 states 1 loading/unloading space shall be provided up to 8,000 sq. ft. & one additional per up to 20,000 sq. ft.; site plan does not have a loading/unloading area marked out. ZP25-50 Width & length of loading/unloading space & total area Section 604.0 states the width shall be a minimum of 12 feet, length 70 feet, & total area 840 sq. ft.; currently nothing is marked out. ZP25-51 Driveway set back, materials, & width Section 606.0(B) states set back minimum of 20 feet from the nearest side & rear lot lines & be constructed of a durable all-weather surface such as aggregate, concrete, or asphalt & be a minimum of 15 feet in width; applicant states 33 feet on Nash Rd. NearMap indicates approximately 15 feet. ZP25-52 Permit for a driveway that intersects a state, county or township road Section 606.0(C) states a permit shall be secured from the appropriate governmental authority & a copy provided to the zoning inspector as part of an application for a zoning certificate; applicant states it has been submitted & will take 4 to 6 weeks for an answer. Geauga Highway Co. has filed applications for a use and area zoning certificates and wants them to be granted in order to continue to operate a heavy highway, municipal, commercial paving & construction company for the property located in the B-1 zoning district at 14126 Main Market Road in Troy Township PPN # 32-000200.

These applications submitted by John Bojec, requests that he be granted relief regarding AREA zoning certificates for the following. Applications for the below appeals pertain to Article IV. ZP25-35 for lot coverage Section 402.8 which states that “the maximum lot coverage shall be 10 percent and he wishes for 24.6 percent for a variance of 14.6 percent. ZP25-53 for side yard setback Section 402.6(B)(2) which states each side yard setback is 25 feet and he wishes for 18 feet for a variance of 7 feet.
