Robert D. Cosgrove, whose last known address was 10760 Ravenna Road, #202, Twinsburg, Ohio 44087, and whose current place of residence and whereabouts are unknown and cannot with reasonable diligence be ascertained, will take notice that on May 12, 2022, Sharon L. McBride filed her Complaint for Forfeiture and Default of Land Installment Contract and Damages, at the Geauga County Court of Common Pleas, 100 Short Court Street, Chardon, Ohio 44024, in the case styled as Sharon L. McBride v. Robert D. Cosgrove, Geauga County Court of Common Pleas Case No. 22-F-000270 and: (1) praying that the that the Land Contract between the parties be forfeited and cancelled, that possession of 15163 Burton-Windsor Road, Middlefield, Ohio 44062 be restored to Sharon L. McBride, that Robert D. Cosgrove be forever barred and enjoined from asserting any right, title and interest in the 15163 Burton-Windsor Road, Middlefield, Ohio 44062, that Sharon L. McBride be awarded judgment in an amount to be proven at trial or hearing, for reasonable cost of repairs and replacements, that Robert D. Cosgrove be ordered to pay all court costs, and that Sharon L. McBride be awarded such other legal and equitable relief to which she may be entitled; and (2) alleging that Robert D. Cosgrove has breached the parties’ Land Contract by failing to make all installment payments due under the Land Contract, by failing to pay the real estate taxes for 15163 Windsor-Burton Road, Middlefield, Ohio 44062; and (3) also alleging that Robert D. Cosgrove caused damage to 15163 Windsor-Burton Road, Middlefield, Ohio 44062.
Robert D. Cosgrove is hereby notified that he is required to serve and answer to Sharon L. McBride’s Complaint for Forfeiture and Default of Land Installment Contract and Damages within twenty-eight (28) days after the last publication, with said publication to run for six consecutive weeks. The answer must be served by December 8, 2022. In case you fail to answer or otherwise respond as required by the Ohio Rules of Civil Procedure, judgment by default may be rendered against you.
