15-M-000978 – Grandview Investment Group, LLC, Plaintiff vs. John Zivko, et al., Defendant
Traci Holzheimer, whose last known place of residence was 16400 Jug Road, Burton, OH 44021, otherwise whose address is unknown, will take notice that on December 18, 2015, Plaintiff filed its Complaint in Case No. 15-M-000978 in the Court of Common Pleas, Geauga County, 100 Short Court, Chardon, OH 44024, alleging that on or about March 1, 2015, Grandview Investment Group, LLC (“Table”); John Zivko (“Zivko”) and Traci Holzheimer (“Holzheimer”) executed a Lease Agreement (“Lease”) with Grandview, renting space for use as a restaurant; that on or about March 1, 2015, Table, pursuant to the Lease, took possession of the Property; that on or about October 1, 2015, Table vacated the Property; that Grandview has never received any payments on the Fixed Minimum Rent from Zivko, Holzheimer or Table; that despite Grandview’s demand for payment, Zivko, Holzheimer and Table refuse to pay Grandview any amount for the Fixed Minimum Rent or utilities; that Grandview has not received any payments on the Fixed Minimum Rent for the Property from Zivko, Holzheimer or Table; that Grandview has paid utility bills on behalf of Zivko, Holzheimer or Table in the amount of $18,463.58; that Zivko, Holzheimer or Table are indebted to Grandview for Fixed Minimum Rent in the principal amount of $13,000.00 through December 31, 2015; that Zivko, Holzheimer or Table will continue to owe the Fixed Minimum Rent until the Property is relet; that Zivko, Holzheimer or Table have incurred late payment charges of five (5%) of the sums overdue on the Lease through December 31, 2015 in the amount of $8,478.58; that despite Grandview’s demand for payment, Zivko, Holzheimer and Table have failed and refused to pay Grandview any amount due on the Lease; that as direct and proximate result of Table’s breach of the Lease, Grandview had been damaged and is entitled to recover from Zivko, Holzheimer or Table $39,942.16 plus ongoing accrued expenses to be proven at trial, plus interest and costs.
Plaintiff demands the Court to enter a Declaratory Judgment in favor of Grandview that Zivko and Holzheimer are guarantors for performance of the terms of Lease and payment of rent, utilities, late charges, costs and reasonable attorney fees on the Lease; and Judgment against Zivko, Holzheimer and Table for recovery of the principal amount of $39,942.16, plus ongoing accrued Fixed Minimum Rent, utility expenses and late charges, for recovery of costs in this action and recovery of reasonable attorney fees and any other relief this Court deems available at law or in equity.

AN ORDINANCE ADOPTING SECTION 1147.271 ALLOWING THE COUNCIL TO DETERMINE WHEN PART 11 PLANNING AND ZONING CODE REQUIREMENTS SHALL NOT APPLY TO A MUNICIPAL PROJECT OR MUNICIPAL PROPERTY.
An ordinance adopting Section 1147.271 allowing the Council to determine when Part 11 Planning and Zoning Code Requirements shall not apply to a municipal project or municipal; requiring a public hearing and notice thereof to all property owners within 200 feet of the project to consider comments and letters, and adopting criteria for the Council to consider before approving a plan which does not comply with all requirements of Part 11, Codified Ordinances.

AMENDMENTS TO
GEAUGA PARK DISTRICT BYLAWS
The following articles contains amendments to the Bylaws of Geauga Park District as approved by the Board of Commissioners, February 9, 2016:
ARTICLE XI PAYMENT OF BILLS AND OBLIGATIONS
All vouchers in payment of bills shall be certified by the Executive Director, Deputy Director, or the Executive Directors’ designee. Expenditure Vouchers and Payroll Vouchers shall be approved and certified to the Geauga County Auditor by the Executive Director, Deputy Director, or the Executive Directors’ designee, and shall be ratified by the Park Board.
ARTICLE XII CONTRACTUAL RELATIONSHIP, BOARD APPROVAL
No contract, agreement, deed, option or other document or action creating any right or obligation, contractual relationship from, in or to the Park Board shall be executed, given, transferred, assigned, delivered, accepted or received on behalf of the Park Board except with the approval or authorization of the Park Board, unless same has been approved in the annual appropriations, and/or unless it is not covered by the competitive bidding requirements of ORC 307.86. The Executive Director, Deputy Director, or the Executive Directors’ designee have authority to execute change orders on existing goods or services of approved annual appropriations and other contracts not covered by the requirement of ORC 307.86 to the extent they do not exceed the budgeted amount approved by the Park Board.

Notice is hereby given that in pursuance of a Resolution of the Board of Education of the Newbury Local School District, Ohio, passed on the 4th day of December, 2015, there will be submitted to a vote of the people at the Primary Election to be held at the regular places of voting on Tuesday, the 15th day of March, 2016, the question of levying a tax, in excess of the ten mill limitation, for the benefit of the Newbury Local School District for the purpose of:

Said tax being: a renewal of an est. tax at a rate not exceeding 4.7 mills for each one dollar of valuation, which amounts to 47 cents for each one hundred dollars of valuation, for ten years.

Notice is hereby given that in pursuance of a Resolution of the Commissioners of Geauga County, Ohio, passed on the 25th day of June, 2015, there will be submitted to a vote of the people at the General Election to be held at the regular places of voting on Tuesday, the 15th day of March, 2016, the question of levying a tax, in excess of the ten mill limitation, for the benefit of Geauga County for the purpose of:
GENERAL CONSTRUCTION, RECONSTRUCTION, RESURFACING, AND REPAIR OF STREETS, ROADS AND BRIDGES
Said tax being: an additional tax at a rate not exceeding 2.5 mills for each one dollar of valuation, which amounts to 25 cents for each one hundred dollars of valuation, for five years.
