A RESOLUTION IMPLEMENTING SECTIONS 3735.65 THROUGH 3735.70 AND SECTION 5709.85 OF THE OHIO REVISED CODE, AMENDING THE BOUNDARIES OF COMMUNITY REINVESTMENT AREA, TO INCLUDE THE CONTIGUOUS INDUSTRIALLY ZONED PROPERTIES BORDERING STATE ROUTE 422 AND RAPIDS ROAD, IN THE TOWNSHIP OF TROY, GEAUGA COUNTY, AND DESIGNATING A HOUSING OFFICER TO ADMINISTER THE PROGRAM, CREATING A COMMUNITY REINVESTMENT HOUSING COUNCIL AND CREATING A TAX INCENTIVE REVIEW COUNCIL.
WHEREAS, the Board of Commissioners of Geauga County, Ohio (hereinafter “Board” ) by Resolution No. 97.054 adopted April 15, 1997, designated the area as a “Troy Township Community Reinvestment Area” pursuant to Chapter 3735 of the Ohio Revised Code; and it was certified by the State of Ohio May 1st, 1997; and
WHEREAS, the “Board” wishes to expand the Troy Township Community Reinvestment Area to include additional real estate; and
WHEREAS, The “Board” has determined that it is in the best interest of the County to expand the Troy Township Community Reinvestment Area as provided by Ohio Revised Code (ORC) Section 3735.65 through 3735.70; and
WHEREAS, a survey of housing, as required by Ohio Revised Code (ORC) Section 3735.66 has been prepared for the area to be included in the amended Troy Township Community Reinvestment Area; and shall be incorporated herein; and
WHEREAS, the maintenance of existing and construction of new structures in such area would serve to encourage economic stability, maintain real property values, and generate new employment opportunities; and
WHEREAS, the remodeling of existing structures or the construction of new structures in this Community Reinvestment Area constitutes a public purpose for which real property exemptions may be granted.
NOW THEREFORE, BE IT RESOLVED BY THE “BOARD,” THAT:
Section 1: Pursuant to ORC Section 3735.66, the Board hereby amends the Troy Township Community Reinvestment Area to encompass the following described area:
The Troy CRA incorporates industrially zoned properties in the southwest section of Troy Township which includes the north and south properties bordering State Route 422 and includes the contiguous industrially zoned properties along the western border of Rapids Road.
Those properties include the following parcels south of SR 422; 32.074273, 32.074273, 32.072327, 32.072326, 32.072324, 32.072323, 32.072321, and 32.072320. The western border parcel north of State Route 422 is 32.043900. The northernmost border parcels are; 32.043900, 32.001100, 32.074124. Also included are the eastern parcels which run along the western border of Rapids Road including; 32.074124, 32.074372, 32.074266,32.072295, 32.001100, 32.072377, 32.022500, 32.066350, 32.022500, 32.022401 and 32.701500. The northern properties which run along the southern border of State Route 422 are: 32.043900, 32.074043, 32.074202, 32.036400, 32.002085, 32.002087, 32.030100, 32.074267, 32.074278, 32.022400, 32.022401, 32.002080, and 32.002086.
The Troy Township Community Reinvestment Area is approximately depicted as the area on the map attached to this resolution as Exhibit “A” which is incorporated by reference. Only commercial and industrially zoned properties consistent with the applicable zoning regulations within the designated Troy Township Community Reinvestment Area will be eligible for exemptions under this program.
Section 2: Within the above described Troy Township Community Reinvestment Area tax exemptions for improvement to real property as described in ORC Section 3735.67 will be granted. For the construction of commercial or industrial structures located in said area as provided in ORC 3735.67(C), an exemption can be granted up to 15 years.
Section 3: The Board hereby designates the Director of Community and Economic Development for Geauga County as the Housing Office for all Geauga County CRA zones.
Section 4: A “Community Reinvestment Area Housing Council” shall be created, consisting of three members appointed by the Geauga County Board of Commissioners and two members appointed by the Geauga County Planning Commission. The majority of the members shall then appoint two additional members who shall be residents of Troy Township. Terms of the members of the Council shall be for three years. An unexpired term resulting from a vacancy in the Council shall be filled in the same manner as the initial appointment was made. The Community Reinvestment Area Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC. The Council shall also hear appeals under Section 3735.70 of the ORC.
Section 5: A Tax Incentive Review Council shall be established pursuant to ORC Section 5709.85 and shall consist of three representatives appointed by each member of the Board of County Commissioners, two representatives of Troy Township, appointed by the Troy Township Board of Trustees, the Geauga County Auditor (or designee) and one representative each appointed by the Boards’ of Education of Berkshire School District and Auburn Career Center. At least two members of the Council must be residents of Troy Township. The Tax Incentive Review Council shall review annually the compliance of all agreements involving the granting of exemptions for industrial real property improvements under Section 3735.671, of the ORC and make written recommendations to the Council as to continuing, modifying or terminating said agreement based upon the performance of the agreement.
Section 6: The Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, that all deliberations of this Board and of its committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.22 of the ORC.
Section 7: This Resolution shall take effect and be enforced from and after the earliest period allowed by law and upon confirmation of the findings in this Resolution by the Director of the Ohio Development Services Agency.
Section 8: The Community & Economic Development office is directed to forward this Resolution to the County Auditor for informational purposes.
Section 9: The Community & Economic Development office is directed to publish this resolution in a newspaper of general circulation in the County of Geauga once a week for two consecutive weeks immediately following its adoption.
