Geauga County intends to apply to the Ohio Development Services Agency, Office of Community Development, for funding under the FY-2016 Community Development Block Grant (CDBG) Small Cities Program, a federally funded program administered by the State of Ohio. Geauga County is eligible to apply for these categories of funding for FY-2016 providing the County meets applicable program requirements.

Geauga County is eligible for CDBG Allocation funding of approximately $250,000 and $600,000 in Neighborhood Revitalization and Critical Infrastructure Funds. These projects can include: public service, public improvements, recreational activities, street, infrastructure, drainage, water and sewer improvements, demolition of unsafe structures, rehabilitation of neighborhood, rental, and housing rehabilitation, economic development, and counseling activities. The activities must primarily benefit low to moderate income persons, or aid in the prevention of slums and blight.
Citizens are encouraged to attend this public hearing on Tuesday, April 26, 2016 at 9:30 a.m. in the Commissioners Chambers at 470 Center Street, Building Four in Chardon for more information on the grant and program requirements. Geauga County intends to apply to the State of Ohio Community Services Division, Office of Community Development for $500,000 in funding under the FY-2016 Community Development Block Grant Economic Development Grant (CDBG) program, a federally funded program administered by the State.
This second public hearing will be held on April 26, 2016 at 9:35 a.m. in Commissioners Chambers at 470 Center Street, Building 1A, Chardon. The first hearing was held on April 26th to inform citizens about the CDBG programs and how they may be used, what activities are eligible, and important program requirements.  The application for consideration in the 2016 CDBG Economic Development Grant is listed with National Objective:

National Benefit: L/M Income Jobs
Activity: Purchase of land, construction of building and purchase of machinery and equipment.

A RESOLUTION IMPLEMENTING SECTIONS 3735.65 THROUGH 3735.70 AND SECTION 5709.85 OF THE OHIO REVISED CODE, ESTABLISHING AND DESCRIBING THE BOUNDARIES OF COMMUNITY REINVESTMENT AREA IN THE  TOWNSHIP OF BURTON, GEAUGA COUNTY, DESIGNATING A HOUSING OFFICER TO ADMINISTER THE PROGRAM, AND CREATING A COMMUNITY REINVESTMENT HOUSING COUNCIL AND A TAX INCENTIVE REVIEW COUNCIL.
WHEREAS, the Board of Commissioners of Geauga County (hereinafter “Board”) desires to pursue all reasonable and legitimate incentive measures to assist and encourage development in specific areas of the County of Geauga that have not enjoyed reinvestment from remodeling or new construction;
WHEREAS, a survey of housing, a copy of which is on file in the office of Community and Economic Development as required by Ohio Revised Code (ORC) Section 3735.66 has been prepared for the area to be included in the proposed Community Reinvestment Area;

WHEREAS, the construction of new structures in this Community Reinvestment Area constitutes a public purpose for which real property exemptions may be granted.
NOW THEREFORE, BE IT RESOLVED BY THE COUNTY OF GEAUGA, OHIO, THAT:
Section 1: The area designated as the Burton Township Community Reinvestment Area constitutes an area in which housing facilities or structures of historical significance are located, and in which new construction or repair of existing facilities has been discouraged:
Section 2: Pursuant to ORC Section 3735.66, Burton Township Community Reinvestment Area is hereby established in the following described area:
The CRA property is located either wholly or partially within Lots 49, 50, 59 and 60 of Burton Township. This section of Burton is located in the far eastern section adjacent to Middlefield Township and encompasses properties north and south of Kinsman Road (SR87) in lots 49, 50, 59 and 60. The Southeast portion of the Burton CRA zone is located entirely within Burton Lot 60. Lot 60 is bordered on the North by Kinsman Road, on the South by Burton Lot 70, on the East by Middlefield Township Lot 30 and 31, on the west a portion of Burton Lot 59 in the Southwest portion. The Southwest portion is bordered by Burton Lot 69 to the south and properties owned by T.L. Schaeffer parcel #04.145922 and Clark Family LP parcels: #04.005650 and #04.005050 to the west. Burton CRA zone is located within Burton Lots 49 and 50. Lots 49 and 50 are bordered on the north by Burton Lots 39 and 40, on the east by Middlefield Lots 21 and 40, on the west by properties owned by City of Akron parcels #04.707132 and #04.404130. Parcels #04.100500 and #04.100400 owned by Harold William Moss and parcel #04.045700 owned by Ralph Fritinger are included in the Burton CRA zone.  Burton CRA zone is bordered on the Northwest by properties owned by City of Akron parcels 04.707130 and 04.707136 and Impullitti Holdings parcel 04.131700. On the Southwest the CRA is bordered by properties owned by the Clark Family LP parcels #04.005050 and #04.005650 and T.L. Schaeffer parcel #04.145922. Burton CRA is bordered on the Northeastern by Middlefield Lots 21, 30 and 31.
The Burton Township Community Reinvestment Area is approximately depicted as the crosshatched area on the map attached to this Resolution (see Exhibit A) and by this reference incorporated herein.
Only industrial properties consistent with the applicable zoning regulations within the designated Community Reinvestment Area will be eligible for exemptions under this Program.
Section 3: All properties identified in Exhibit A as being within the designated Community Reinvestment Area are eligible for this incentive (the county may determine that all new industrial uses are eligible).  This proposal is a public/private partnership intended to promote and expand conforming uses in the designated area. As part of the project, the County of Geauga intends to undertake supporting public improvements in the designated area.
Section 4: Within the Community Reinvestment Area, the percentage of the tax exemption on the increase in the assessed valuation resulting from improvements to industrial real property and the term of those exemptions, shall be negotiated on a case-by-case basis in advance of construction or remodeling occurring according to the rules outlined in the ORC Section 3765.67. The results of the negotiation as approved by the Board will be set in writing in a Community Reinvestment Area Agreement as outlined in ORC Section 3735.671.
Section 5: All industrial projects are required to comply with the state application fee requirements of ORC Section 3735.672 (C) and the local annual monitoring fee of one percent of the amount of taxes exempted under the agreement – a minimum of $500 up to a maximum of $2500 annually unless waived.
Section 6: To administer and implement the provisions of this Resolution, the Director of the Department of Community and Economic Development is designated as the Housing Officer as described in Sections 3735.65 through 3735.70.
Section 7: A “Community Reinvestment Area Housing Council” shall be created, consisting of three members appointed by the Geauga County Board of Commissioners and two members appointed by the Geauga County Planning Commission.  The majority of the members shall then appoint two additional members who shall be residents of Burton Township. Terms of the members of the Council shall be for three years.  An unexpired term resulting from a vacancy in the Council shall be filled in the same manner as the initial appointment was made. The Community Reinvestment Area Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC. The Council shall also hear appeals under Section 3735.70 of the ORC.
A Tax Incentive Review Council shall be established pursuant to ORC Section 5709.85 and shall consist of three representatives appointed by each member of the Board of County Commissioners, two representatives of Burton Township, appointed by the Burton Township Board of Trustees, the Geauga County Auditor (or designee) and one representative each appointed by the Boards’ of Education of Berkshire School District and Auburn Career Center. At least two members of the Council must be residents of Burton Township.  The Tax Incentive Review Council shall review annually the compliance of all agreements involving the granting of exemptions for industrial real property improvements under Section 3735.671, of the ORC and make written recommendations to the Council as to continuing, modifying or terminating said agreement based upon the performance of the agreement.
Section 8: The council reserves the right to re-evaluate the designation of the Burton Township Community Reinvestment Area after December 31, 2017, at which time the Council may direct the Housing Officer not to accept any new applications for exemptions as described in Section 3735.67 of the ORC.
Section 9: The Community Reinvestment Area Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC.  The council shall also hear appeals under 3735.70, of the ORC.
Section 10: The Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, that all deliberations of this Board and of its committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.22 of the ORC.
Section 11: This Resolution shall take effect and be enforced from and after the earliest period allowed by law and upon confirmation of the findings in this Resolution by the Director of the Ohio Development Services Agency.
Section 12: The Board of Commissioners of Geauga County hereby petitions the Director of the Ohio Development Services Agency to confirm the findings contained within this Resolution.
