NATIONSTAR MORTGAGE LLC, D/B/A MR. COOPER, Plaintiff vs. JAMES KORMOS, ET AL., Defendants

In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, at the door of the Court House, in the City of Chardon, in the above named County, on Thursday, the 6th day of June, 2019, at 10:00 o’clock A.M., and if the parcel does not receive a sufficient bid, it shall be offered for sale, without regard to the minimum bid requirement, at the same time of day and at the same place of the first sale, on Thursday, the 20th day of June, 2019 the following described real estate, situated in the County of Geauga and State of Ohio, and in the Township of Bainbridge to wit:

Situated in the Township of Bainbridge, County of Geauga, and State of Ohio, and known as being a part of Original Bainbridge Township Lot No. 8, Tract No. 2, and also being a part of the land as recorded in Volume 218, Page 373 of the Geauga County Records of Deeds, and bounded and described as follows:

Beginning on an iron spike on the center line of the Solon-Auburn Road (County Road 11, 60 feet wide) which bears North 88° 27’ 21” East 806.93 feet measured along the center line of the said Solon-Auburn Road from an iron pipe set at the intersection of the center lines of Geauga Lake Road (County Road 183, 60 feet wide) and the said Solon-Auburn Road and passing through an iron pipe 227.57 feet therefrom, which marks the southeast corner of Original Lot No. 7 and the southwest corner of Original Lot No. 8, to the principal place of beginning of this survey, which beginning point is also the southeast corner of a proposed road (60 feet wide);

Thence North 00° 57’ 39” West 1500.00 feet along the east line of the proposed road to an iron pipe;

Thence North 88° 27’ 21” East 164.00 feet parallel with the said Solon-Auburn Road to an iron pipe;

Thence South 00° 57’ 39” East 1500.00 feet parallel with the west line and passing through an iron pipe on the north margin of said Solon-Auburn Road to an iron spike on the center line of said road;

Thence South 88° 27’ 21” West 164.00 feet along the center line of said road to the place of beginning.

Containing 5.647 acres of land. Bearings are given to indicate angles only. Survey and description made and prepared by I.S. Speer, Registered Surveyor No. 1262.

Excluding the following:

Being a parcel of land lying on the left and right sides of the center line of a survey made by the Department of Highways and recorded in Volume 470, Page 884 and Book 470, Page 885 of the Records of Geauga County and being located within the following described points in the boundary thereof;

Beginning at a point in the westerly property line of land conveyed to Elmer Kormos and Anne Kormos by deed recorded in Volume 259, Page 462 of Geauga County Records (and Volume 239, Page 491) at its intersection with the proposed southerly right of way line of United States Route 422, 133.87 feet right of Station 2207 + 68.35;

Thence Northwesterly along said westerly property line passing through the centerline at Station 2207 + 54.48, a distance of 269.37 feet to a point in the proposed northerly right of way line of United States Route 422, which point is 134.09 feet left of Station 2207 + 40.89;

Thence Southeasterly along the proposed right of way line on a curve to the right having a radius of 11429.16 feet, a distance of 164.89 feet to a point in the easterly property line of land so conveyed, which point is 134.55 feet left of Station 2209 + 03.99;

Thence Southeasterly along said easterly property line passing through the centerline at Station 2209 + 19.44, a distance of 268.89 feet to a point in the proposed southerly right of way line of United States Route 422, which point is 132.55 feet right of Station 2209 + 34.99;

Thence Northwesterly along said proposed southerly right of way line, a distance of 133.53 feet to a point 133.00 feet right of Station 2208 + 00;

Thence continuing Northwesterly along said proposed southerly right of way line, a distance of 31.32 feet to the place of beginning.

Containing 1.01 acres of land, more or less, exclusive of the present road which occupied 0.00 acres, more or less. Description based on a survey made by Lewis S. Harvey, Registered Surveyor No. 4369.

Being a parcel of land lying on the left side of the center line of a survey made by the Department of Highways and recorded in Book 470, Page 882 and Book 470, Page 883 of the Records of Geauga County and being located within the following described points in the boundary thereof:

Beginning at a point in the westerly property line of land conveyed to Elmer Kormos and Anne Kormos by deed recorded in Volume 259, Page 462 of Geauga County Records at its intersection with the proposed northerly right of way line of United States Route 422, 134.09 feet left of the centerline of United States Route 422 at Station 2207 + 40.89;

Thence Northwesterly along said westerly property line, a distance of 7.62 feet to the northwesterly corner of land so conveyed, which corner is 141.67 feet left of said centerline at station 2207 + 40.13;

Thence Northeasterly along the northerly property line of land so conveyed, a distance of 164.00 feet to the northeasterly corner of land so conveyed, which corner is 160.92 feet left of the said centerline at Station 2209 + 01.01;

Thence Southeasterly along the easterly property line of land so conveyed, a distance of 26.55 feet to a point in the proposed northerly right of way line of United States Route 422, which point is 134.55 feet left of said centerline at Station 2209 + 03.99;

Thence Northwesterly along said proposed northerly right of way line on a curve to the left having a radius of 11429.16 feet, a distance of 164.89 feet to the place of beginning.

Containing 0.06 acres of land, more or less, exclusive of the present road which occupies 0.00 acres, more or less. Description based on a survey made by Lewis S. Harvey, Registered Surveyor No. 4369.

DEPOSIT: Pursuant to O.R.C. 2329.211, the required deposit for this offering shall be $5,000.00. Said deposit shall be CASH or CERTIFIED CHECK, payable to the Geauga County Sheriff.

The purchaser shall be responsible for those costs, allowances, and taxes that the proceeds of the sale are insufficient to cover.

Said Premises appraised at ($125,000.00) and cannot be sold for less than two-thirds of that amount ($83,334.00). Please note: The appraisals are based on an exterior appraisal of property only, unless otherwise noted.

TERMS OF SALE: The FULL purchase price shall be paid to the Sheriff within thirty (30) days from the date of confirmation of sale, and on failure to do so, the purchaser may be held in contempt of court, the court may forfeit the sale and/or deposit, or the court may issue any other order it sees fit.
