An Aurora woman has been indicted in connection with a March 26 fatal traffic accident that killed a pedestrian on Chagrin Road in Bainbridge Township.

A Geauga County grand jury has charged 29-year-old Brooke Jarvis, of Aurora, with one count of aggravated vehicular homicide, a second-degree felony, in the crash that killed pedestrian Chadwick McIntosh, 32, of Mineral Ridge, according to a June 21 indictment filed in Geauga County Common Pleas Court.

Jarvis also faces two counts of first-degree misdemeanor operating a vehicle under the influence of alcohol, a drug of abuse, or a combination of them; and one count of aggravated possession of drugs, a fifth-degree felony.

According to Chardon Municipal Court records, Jarvis had a blood-alcohol content of .212 at or near the time of the March 26 crash.

Jarvis, who was released from the Geauga County Safety Center after posting a $50,000 surety bond, is scheduled to be arraigned June 30. Cleveland defense attorneys Ian Friedman and Larry Zukerman are representing Jarvis, according to common pleas court records.

“Our hearts and thoughts go out to the family and loved ones of Mr. McIntosh, as it is a tragedy any time a life is lost,” Friedman and Zukerman said in a joint statement. “We respectfully submit, however, that the evidence in this case will reveal that this terrible loss was unavoidable and for reasons not attributable to Ms. Jarvis. We look forward to all of the relevant facts being exposed during the court process.”

Bainbridge Township Police Chief Jon Bokovitz previously told the Geauga County Maple Leaf that Jarvis was driving — with a passenger in her SUV — eastbound on Chagrin Road at approximately 10:30 p.m. March 26 when she struck McIntosh, who was walking also in the eastbound lane with a woman, from behind just east of Savage Road. He was pronounced dead at the scene.

The woman, a Bainbridge Township resident and McIntosh’s girlfriend, was not struck.

Jarvis, who works for her family’s equine and farm insurance agency, has no prior criminal history, according to court records.

Bokovitz said Jarvis did stop at the scene and another motorist, who also was traveling eastbound and came upon the scene, called 9-1-1 to report the accident.

A law enforcement source familiar with the investigation told the Maple Leaf that Jarvis was at The Greenville Inn in Bainbridge before the crash.

Geauga County Prosecutor Jim Flaiz declined to comment on the case.
